The Legal Questions

For public intoxication under Penal Code section 647(f), the prosecution must establish intoxication in a public place together with inability to care for personal or others' safety, or obstruction of a public way because of the intoxication. Drinking alcohol in public does not by itself establish all of those elements.

Other disorderly-conduct subdivisions and disturbing-the-peace allegations require their own elements. The citation and subsection should be identified before evaluating conduct or a proposed resolution.

Examine Impairment, Location and Actual Conduct

Drinking is not the complete charge

Section 647(f) requires more than evidence that someone consumed alcohol or appeared intoxicated. The prosecution must establish the qualifying public setting and the required inability to care for safety, or the specified interference with a public way resulting from intoxication. An odor of alcohol, a statement about drinking or a test result does not automatically establish every element.

The setting can be disputed

A public sidewalk, an area open to customers and a restricted private space may present different questions. Photographs of access points, fences and signs can help explain the setting. The sequence also matters if an officer directed the person to move from a private place to a public one. Counsel examines where and in what circumstances the alleged offense occurred.

Medical evidence may explain observed symptoms

Low blood sugar, neurological conditions, injury or medication effects can affect balance, speech and awareness. Treatment notes, paramedic observations, testing and the timing of symptoms should be compared with witness accounts and recordings. The question is not merely whether another explanation is possible, but whether the evidence establishes the charged intoxication and incapacity or obstruction.
