The Legal Questions
Penal Code section 273a contains different theories. For the felony provision, the circumstances must be likely to produce great bodily harm or death. Direct infliction and indirect causing or permitting harm have different mental-state analysis; criminal negligence applies to the relevant indirect theories.
Actual great bodily injury is not required for every endangerment theory. Criminal negligence involves more than ordinary carelessness or a mistake in judgment. Reasonable discipline, where legally relevant and supported by the evidence, must be distinguished from unjustifiable pain or excessive force.
Penal Code section 273d separately addresses willful infliction of cruel or inhuman physical punishment or injury causing a traumatic physical condition. The condition can be minor or serious. That injury-based charge should not be confused with every endangerment theory under section 273a.

Section 273a can address directly inflicted unjustifiable pain or suffering, permitting harm, or exposing a child to danger under the required circumstances. Direct infliction and indirect endangerment do not always use the same mental-state formulation. Criminal negligence is more than ordinary carelessness. Section 273d separately concerns the specified corporal punishment or injury producing a traumatic condition.
Medical timing must be connected to the caregiver
Imaging, treatment notes and qualified medical opinions may address the nature, likely cause and approximate age of an injury. Childcare records, photographs, witness observations and schedules may show who had access during the relevant interval. A diagnosis alone does not necessarily identify a perpetrator or establish the statutory mental state.
Test alternative explanations against the complete record
An accidental fall or an earlier event may be relevant, but its consistency with the injury and child's developmental abilities must be evaluated. Conflicting estimates should be identified rather than collapsed into a single assumed timeline. Separate dependency proceedings or protective orders may impose obligations while the criminal allegations remain contested; their existence should not be treated as a criminal conviction.
